REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on November 27, 1962, at 10 a.m., in Room 320E, State Capitol, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law and the rules and regulations of the Commission, on the application of John G. McMillian, Jr., President of Mallard Petroleum, Inc., for an order authorizing, as an exception to the spacing pattern established by' Order No. 112-6, the location of a well to be drilled 1545 feet west of the east line and 1585 feet north of the south line of Section 13, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado, as a test well for the production of gas from the Mesaverde formation; and that the E½ of said Section 13 be designated as the drilling unit for the Mesaverde formation.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the E½ of Section 13, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado, should be designated as the drilling unit for production of gas from the Mesaverde formation; and that, insofar as it pertains to production of gas from said Mesaverde formation, an exception to Order No. 112-6 should be allowed for a well to be drilled 1545 feet west of the east line and 1585 feet north of the south line of said Section 13; and that such well should be the permitted well for the drilling unit upon which it is located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the E½ of Section 13, Township 32 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for production of gas from the Mesaverde formation; and an exception to Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, is hereby allowed for a test well to be located 1545 feet west of the east line and 1585 feet north of the south line of said Section 13; and said well shall be the permitted well for the drilling unit upon which it is located.
