REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on July 17, 1962, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waiver of Service, as required by law and the rules and regulations of the Commission, on the application of Fred W. Pool, as Operator for the Durango Syndicate, for an order authorizing as an exception to the spacing patterns established by Order No. 112-6 for the Dakota and Mesaverde formations, the location of a well to be drilled in the SW¼ of Section 14, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, and designating the W½ of said Section 14 as the drilling unit for the Mesaverde formation.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the W½ of Section 14, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, should be designated as the drilling unit for production of gas from the Mesaverde formation.

4.      That, insofar as it pertains to production of gas from the Mesaverde formation, an exception to Order No. 112-6 should be granted for a well to be drilled at least 1320 feet from the west line and 1320 feet from the south line of Section 14, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado; and that such well should be the permitted well for the drilling unit upon which it is located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the W½ of Section 14, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for production of gas from the Mesaverde formation; and an exception to Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, is hereby allowed for a well to be located at least 1320 feet from the west line and 1320 feet from the south line of said Section 14; and said well shall be the permitted well for the drilling unit upon which it is located.
