REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on March 21, 1961, at 10 a.m., in Room 227, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of Irving Pasternak, doing business as the Shar-Alan Oil Company, for an order allowing a well to be drilled as an exception to Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, such well to be located at least 1320 feet north of the south line and 1320 feet east of the west line of Section 25, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado; and designating the S½ of said Section 25 as the established drilling unit for said Mesaverde formation.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the S½ of Section 25, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, should be designated as the drilling unit for production of gas from the Mesaverde formation.

4.      That, insofar as it pertains to production of gas from the Mesaverde formation, an exception to Order No. 112-6 should be allowed for a well to be located 1430 feet from the south line and 1470 feet from the west line of said Section 25; and that such well should be the permitted well for the drilling and spacing unit upon which it is located.

ORDER

NOW, THEREFORE, IT IS ORDERED that the S½ of Section 25, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for the production of gas from the Mesaverde formation; and an exception to Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, is hereby granted for a well to be located 1430 feet from the south line and 1470 feet from the west line of said Section 25, and said well shall be the permitted well for the drilling and spacing unit upon which it is located.
