ORDER NO. 109-4

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on January 15, 1974, at 9 a.m. in the Department of Revenue Hearing Room, State Capitol Annex, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission’s own motion to consider the rescinding of orders in Cause No. 109 for the Garmesa Area.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the Commission by its Order No. 109-1 which defined the Garmesa Area and provided that the drilling of additional wells in the Area not be allowed without notice and hearing.  The defined area was extended by Order No. 109-2 and is described as follows:

4. That such drilling restrictions are no longer necessary and to promote future development, said Order No. [sic] 109-1 and 109-2 are no longer necessary and operations in the area known as the Garmesa Area should be governed by the general rules and regulations of the Commission, except for certain lands that have been made subject to the provisions of Order No. 285-1.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order Nos. 109-1 and 109-2 in Cause No. 109 are hereby rescinded, and operations in the area known as the Garmesa Area and as described in Finding 3 herein shall be governed by the general rules and regulations of this Commission, except for the SE¼ Section 35, and the S½N½, S½ Section 36, Township 7 South, Range 103 West, 6th P.M., which lands have been made subject to the provisions of Order No. 285-1.
