REPORT OF THE COMMISSION
This cause came on for hearing before the Commission on May 16, 1972, at 9 a.m., in Room 132, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Trend Exploration Limited for an order granting an exception to the spacing pattern established by Order No. 103-1 for a well to be drilled in the NE¼ NW¼ of Section 23, Township 6 North, Range 90 West, 6th P.M., and that it be the permitted well for the drilling and spacing unit consisting of the E½ NW¼ of said Section 23.
FINDINGS
The Commission finds as follows:
1. That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.
2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.
3. That on April 8, 1957, the Commission issued its Order No. 103-1 which, among other things, established 80-acre drilling and spacing units for the production of oil from the Tow Creek zone [sic] of the Mancos formation underlying the Buck Peak Field, with the permitted well for each unit to be located in the NW¼ and the SE¼ of each quarter section, and no closer than 330 feet from the boundary line of each quarter-quarter section.
4. That evidence presented at the hearing indicates that a well drilled at the permitted location as established by Order No. 103-1 would result in a dry hole and, therefore, an exception should be granted for a well to be drilled in the NE¼ NW¼ of Section 23, Township 6 North, Range 90 West, to be located no closer than 330 feet from the boundaries of said quarter-quarter section, and that it be the permitted well for the drilling unit consisting of the E½ NW¼ of said Section 23.
5. That no objection to Applicant's request was presented.
ORDER
NOW, THEREFORE, IT IS ORDERED, an exception is hereby granted for a well to be drilled in the NE¼ NW¼ Section 23, Township 6 North, Range 90 West, 6th P.M., Buck Peak Field, Moffat County, Colorado, to be located no closer than 330 feet from the boundary line of such quarter-quarter section, and that said well shall be the permitted well for the drilling unit consisting of the E½ NW¼ of said Section 23.
IT IS FURTHER ORDERED that the provisions contained in the above order shall become effective herewith.
