2. Applicant is subject to the findings made and approval of Order No. 407-3586 Order No. 407-3587 Order No. 407-3588 and Order No. 407-3589 attached to this Order as Exhibits 8, 9, 10, and 11, which established one approximate 3,840-acre drilling and spacing unit for DSU No. 1 Application Lands and approved up to 29 horizontal wells within the unit; one approximate 4,800-acre drilling and spacing unit for the DSU No. 2 Application Lands and approved up to 20 horizontal wells within the unit; one approximate 1,920-acre drilling and spacing unit for DSU No. 3 Application Lands and approved up to 10 horizontal wells within the unit; and one approximate 1,600-acre drilling and spacing unit for the DSU No. 4 Application Lands and approved up to eight horizontal wells within the unit and were approved by the Commission on March 6, 2024.

1. Pursuant to the provisions of C.R.S. § 34-60-116, all interests in the drilling and spacing unit established for the Application Lands are hereby pooled, for the development and operation of the Sharon Springs and Niobrara Formations, effective as of the date the Application was filed.
2. The production obtained from the drilling and spacing unit shall be allocated to each owner in the unit on the basis of the proportion that the number of acres in such tract bears to the total number of mineral acres within the drilling and spacing unit; each owner of an interest in the drilling and spacing unit shall be entitled to receive its share of the production of the Wells located on the drilling and spacing unit applicable to its interest in the drilling and spacing unit.
