On April
5, 2004, Tyler Rockies Exploration, Ltd. (“Tyler”), by its attorney filed with
the Commission a verified Application for an order to remove the below-listed
lands from the provisions of Order No. 226-8 and place the lands under the
provisions of Rule 318., providing there will be a tolerance of 200 feet in the
location of each well on a 40-acre tract to accommodate surface features and to
provide sufficient flexibility to allow one (1) well for approximately every 40
acres:

to said hearing in the above-entitled matter at the time and place aforesaid,

prevent the waste of oil and gas, either or both, in the operations of said
field, and to carry out the purposes of the statute.
In accordance with Rule 509., any
interested party desiring to protest the granting of the application or to
intervene on the application should file with the Commission a written protest
or intervention no later than
