On January 16, 2004, Chevron U.S.A.
Inc. (“Chevron”), by its attorney, filed
with the Commission a verified application requesting a variance under
Rule 502.b.(1) and Rule 503.b.(5) to allow notice to be provided only to those
persons to be involuntarily pooled into the University 9-1 Well, located in the
E˝ of Section 9, Township 34 North, Range 9 West, N.M.P.M., instead of providing
notice to all mineral owners in the well, as required in Rule 507.b.(2). Chevron intends to file an application for
involuntary pooling for the April hearing provided the request for variance is
granted.

of oil and gas, either or both, in the operations of said field, and to carry
out the purposes of the statute.
