                                                NOTICE OF ADMINISTRATIVE ORDER BY CONSENT

 

TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:

 

            On October 21, 2003, Colorado Oil and Gas Conservation Commission (“COGCC”) staff conducted an onsite inspection of the proposed Chevron/Texaco #41C-13D Well located in the SE¼ SE¼ of Section 12, Township 6 South, Range 97 West, 6th P.M. The inspection was conducted because of COGCC staff concerns about the impact of building a road and well pad in steep terrain. The inspection revealed the access road to the site had already been built prior to approval of the Application for Permit-to-Drill, (“APD”) Form 2.

 

            On October 29, 2003, COGCC staff issued a Notice of Alleged Violation (“NOAV”) to Petroleum Development Corporation (“PDC”) for the Chevron/Texaco #41C-13D Well. The NOAV cited violation of Rule 303.a., failure to obtain the Director’s approval of an APD before commencing operations with heavy equipment. The NOAV required that PDC explain why the road was built before obtaining permit approval and why COGCC staff should not recommend the assessment of a fine. The abatement deadline for this explanation was December 2, 2003.  On December 1, 2003, PDC responded by letter stating it had obtained landowner permission to build the road and was not aware it needed permit approval from the COGCC.

 

            On December 15, 2003, COGCC staff issued an Administrative Order by Consent (“AOC”) to PDC for the violation of Rule 303.a., failure to obtain the Director’s approval for its APD before commencing operations with heavy equipment on the Chevron/Texaco #41C-13D Well.  On December 17, 2003, Petroleum Development Corporation agreed to and accepted the AOC, including the fine of One Thousand Dollars ($1,000).

 

NOTICE IS HEREBY GIVEN, that the Oil and Gas Conservation Commission of the State of Colorado, pursuant to the above, has scheduled the above-entitled matter for hearing on:

Pursuant to said hearing in the above-entitled matter at the time and place aforesaid, or at any adjourned meeting, the Commission will enter such orders as it deems appropriate and necessary to protect public health, safety and welfare and to prevent the waste of oil and gas, either or both, in the operations of said field, and carry out the purposes of the statute.

 

In accordance with Rule 509., any interested party desiring to protest or to intervene should file with the Commission a written protest or a notice to intervene no later than January 26, 2004 briefly stating the basis of the protest or intervention.  Such interested party shall, at the same time, serve a copy of the protest or notice to intervene to the person filing the application.  An original and nine (9) copies shall be filed with the Commission.
