APPLICATION

 

            COMES NOW, Rosewood Resources, Inc., a Delaware corporation, by its attorneys Dorsey & Whitney LLP and makes application to the Oil and Gas Conservation Commission of the State of Colorado, for an order allowing an exception to the location of a well to be completed in an existing drilling and spacing unit for the Niobrara formation in the Waverly Field (Outside Area), Yuma County, Colorado.  In support thereof, Rosewood Resources, Inc. (referred to herein as "Applicant") states and alleges as follows: 

1.                   That the Applicant is the owner of numerous leasehold interests in Yuma County, Colorado, located within the area requested for an exception location in an existing spacing unit. 

2.                   That the Applicant is requesting that the Monk #2-7 Well be permitted to be drilled to the Niobrara Formation at the following location:  2028’ FNL and 1995’ FEL of Section 7, T4N, R46W, Yuma County, Colorado.

3.                   That the lands covered by this Application have heretofore been spaced for production of gas from the Niobrara formation pursuant to, among other orders, Order No. 328-5 through which 160-acre drilling and spacing units were established, with the two permitted wells to be located in the center of NW quarter quarter section and the SE quarter quarter section with a tolerance of 100 feet.

4.                   Applicant proposes that the Monk #2-7 Well be permitted to be drilled at the proposed exception location to optimize recovery of reserves from the Niobrara Formation based upon geologic considerations.

5.                   That in order to prevent waste and protect correlative rights of all owners in the area surrounding the proposed location, it is reasonable and equitable to permit an exception location to allow the recompletion of a well in the described location.  Applicant also asserts that Rule 318 c of the Rules and Regulations of the Oil and Gas Conservation Commission provides for exception locations when geologic, topographical or environmental conditions warrant a variance from field rules.

6.                   That all contiguous and cornering Owners in lands toward when the well is proposed to be moved who are affected by the exception location have executed waivers consenting to this exception location except those who are set forth on Exhibit A attached hereto.    WHEREFORE, Applicant respectfully requests that this matter be set for hearing at the next regular hearing date, that notice thereof be given as required by law and that upon such hearing the Commission enter its order:

A.        Determining that Monk #2-7 Well to be located in the SW/4NE/4 of Section 7, Township 4 North, Range 46 West, 6th P.M., be permitted to be recompleted in the Niobrara Formation as follows:
