NOTICE OF CONTINUATION OF HEARING

TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:
On January 14, 2002, Colorado Oil and Gas Conservation Commission (“COGCC”) staff received a copy of a letter from the landowner to MarkWest Resources, Inc. (“MarkWest”), operator of the E. Tiffany No. 2-17 Well located in the NE¼ NW¼ of Section 17, Township 32 North, Range 6 West, N.M.P.M. The letter requested that MarkWest remove rig anchors from the well location to allow the landowner to farm.

On January 16, 2002, COGCC staff issued a Notice of Alleged Violation (“NOAV”) to MarkWest requiring the removal of the rig anchors by April 1, 2002. The NOAV cited violation of Rule 1003.a., requiring removal of guy line anchors on crop land at the request of the surface owner. Per return receipt, MarkWest accepted the NOAV on November 20, 2001. On February 15, 2002, COGCC conducted a field inspection of the Tiffany No. 2-17 Well and all rig anchors are still in place.

In accordance with Rule 522.c.(1)., the Director requests the Commission issue an Order Finding Violation of Rule 1003.a., assessing a fine of One Thousand dollars ($1,000.00) for the above violation.

On May 16, 2002, MarkWest filed with the Commission a written request to continue this matter to the July hearing; accordingly the hearing has been rescheduled.

NOTICE IS HEREBY GIVEN, that the Oil and Gas Conservation Commission of the State of Colorado, pursuant to the above, has rescheduled the above-entitled matter for hearing on:
